New Regulations Under The Vetting And Barring Scheme

Late 2009 saw the introduction of the government’s Vetting and Barring Scheme for preventing unsuitable individuals from coming into contact with children and vulnerable adults.

In 2010 the five year change over to the new system continues and if your business is medical, educational, involves care of children, the disabled or the elderly, or is prison service related you may have to take some action.

Which type of criminal records check each or your positions require may have changed because standard CRB checks no longer have access to the information held in the lists of barred individuals that are now maintained by the Independent Safeguarding Authority. The new lists replace the old POCA, POVA, and list 99. That means some jobs that used to require a standard criminal records check now require an enhanced one.

From July 2010, new employees in relevant positions (or those moving into them from another role in your company) can register with the ISA. Not only will the lists be used as a resource for once off enhanced CRB checks, they will be continuously maintained and updated with information on all new workers in positions covered by Vetting and Barring Scheme regulations. Registration will become a legal requirement in November 2010, and workers already filling relevant positions will need to register and be rechecked under the new scheme over the following year.
