You may initially think that if the job doesn’t have too much responsibility and is 'only a bit of driving' then anyone who can point a vehicle in the right direction must be suitable for the job.
This point of view could leave a company in a lot of potential problems. The Health & Safety Executive guidelines for driving at work strongly recommend that driver’s licenses are checked when they join a company. The person responsible for this checking is personally responsible under the Road Traffic Act if they allow someone to drive a vehicle that they are not legally entitled to drive. Section 87 of the Road Traffic Act states that 'It is an offence for a person to cause or permit another person to drive on a road a motor vehicle of any class if that other person is not the holder of a licence authorising him to drive a motor vehicle of that class'. This means that if you let someone drive a lorry when they are only entitled to drive a car then you would be liable and not the individual concerned.
Initial as well as intermittent driving license checking is an important part of a company's procedures. A small check like this can ensure that a company stays on the right side of the law and is not liable to any criminal prosecution.
